The agreement must be provided in a format the participant can understand, and the participant (or their nominee) must have the opportunity to ask questions and seek independent advice before signing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Commission assessors evaluate service agreements on three criteria. First, does the agreement exist and has it been signed by both parties? Second, does the agreement accurately reflect the supports being delivered? Third, do staff understand the terms and operate consistently with what the agreement describes? These clauses reflect the language and structure Commission assessors expect to see. Adapt each clause to match your specific registration groups, service model, and participant cohort.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. Parties and Services<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><em>&#8220;This Service Agreement is entered into between [Provider Legal Name] ABN [XX XXX XXX XXX], NDIS Registration Number [XXXXXXXX] (&#8216;the Provider&#8217;) and [Participant Full Name], NDIS Participant Number [XXXXXXXXXX] (&#8216;the Participant&#8217;). This agreement commences on [start date] and remains in effect until [end date or &#8216;until the Participant&#8217;s current NDIS plan is reviewed, whichever occurs first&#8217;]. The Provider agrees to deliver the supports described in Schedule A of this agreement in accordance with the Participant&#8217;s NDIS plan and the NDIS Practice Standards.&#8221;<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Service Description and Schedule<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><em>&#8220;The Provider will deliver the following NDIS-funded supports as outlined in the Participant&#8217;s current NDIS plan:<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Support Category: [e.g., Assistance with Daily Life]<br>Support Item Number: [e.g., 01_002_0107_1_1]<br>Support Item Name: [e.g., Assistance with Self-Care Activities &#8211; Standard &#8211; Weekday Daytime]<br>Agreed Rate: $[rate] per [hour\/session\/unit]<br>Estimated Frequency: [e.g., 3 hours per week]<br>Location of Service Delivery: [e.g., Participant&#8217;s home \/ community \/ Provider premises]<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The Provider will deliver supports in a manner consistent with the Participant&#8217;s goals as identified in their NDIS plan. Any changes to the supports, frequency, or delivery method will be discussed with the Participant and documented in writing as an addendum to this agreement.&#8221;<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Pricing, Billing, and Payment<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><em>&#8220;All services will be charged in accordance with the current <a href=\"https:\/\/www.ndis.gov.au\/providers\/pricing-arrangements\" target=\"_blank\" rel=\"noopener\">NDIS Pricing Arrangements and Price Limits<\/a> (PAPL) as published by the NDIA. The Provider will not charge above the maximum price specified in the PAPL for any support item. Where the NDIA updates the Price Guide, the Provider will adjust pricing to reflect the current limits and will notify the Participant in writing of any pricing changes.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>For agency-managed participants, the Provider will submit claims through the myPlace portal within [X] business days of service delivery. For plan-managed participants, the Provider will issue invoices to the nominated plan manager within [X] business days. For self-managed participants, the Provider will issue invoices directly to the Participant within [X] business days.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>NDIS-funded supports are GST-free under Division 38 of the A New Tax System (Goods and Services Tax) Act 1999.&#8221;<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Cancellation and No-Show Policy<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><em>&#8220;Where the Participant cancels a scheduled service with less than two (2) clear business days&#8217; notice, the Provider may charge 100% of the agreed fee for the scheduled support, in accordance with the NDIS Cancellation Policy. For Supported Independent Living (SIL) supports, a minimum of seven (7) days&#8217; notice is required for cancellation of regular supports.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Where the Participant is not present for a scheduled service (&#8216;no-show&#8217;) without prior notice, the Provider may charge 100% of the agreed fee. The Provider will make reasonable attempts to contact the Participant before recording a no-show.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The Provider may cancel or reschedule a service by providing the Participant with [X] business days&#8217; notice. The Provider will not charge for services the Provider cancels. Short-notice provider cancellations will include reasonable efforts to arrange alternative support.&#8221;<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5. Complaints, Feedback, and Dispute Resolution<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><em>&#8220;The Participant has the right to provide feedback or raise a complaint about any aspect of the services provided under this agreement. Complaints can be raised:<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Directly with the Provider by contacting [Name\/Role] on [phone number] or [email address]<\/em><\/li>\n<li><em>In writing using the Provider&#8217;s complaint form, available at [location\/URL]<\/em><\/li>\n<li><em>With the NDIS Quality and Safeguards Commission on 1800 035 544 or at <a href=\"https:\/\/www.ndiscommission.gov.au\/participants\/complaints\" target=\"_blank\" rel=\"noopener\">ndiscommission.gov.au<\/a><\/em><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The Provider will acknowledge all complaints within 24 hours and aim to resolve complaints within 21 business days. The Participant will be kept informed of progress throughout the investigation. The Participant&#8217;s services will not be affected by making a complaint.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Where a complaint cannot be resolved through the Provider&#8217;s internal process, either party may refer the matter to an independent mediator or the NDIS Commission.&#8221;<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6. Agreement Review, Variation, and Termination<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><em>&#8220;This agreement will be reviewed at least annually, or when any of the following occurs:<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>The Participant&#8217;s NDIS plan is reviewed or reassessed<\/em><\/li>\n<li><em>The Participant&#8217;s support needs change significantly<\/em><\/li>\n<li><em>The NDIA updates the Pricing Arrangements and Price Limits<\/em><\/li>\n<li><em>Either party requests a review in writing<\/em><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Either party may terminate this agreement by providing [28 days \/ 4 weeks] written notice. In circumstances involving safety concerns or serious breaches, the Provider may terminate the agreement with immediate effect and will assist the Participant in transitioning to alternative supports.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Any variation to this agreement must be agreed in writing by both parties.
