Your service may receive a Working Towards NQS rating or, in more serious cases, Significant Improvement Required. This rating applies where non-compliance poses a significant risk to children’s safety, health or wellbeing.

Compliance notices or directions

Regulatory authorities can issue notices or directions requiring an approved provider to address identified non-compliance within a set timeframe. A compliance notice must allow at least 14 calendar days for compliance.

Show cause notices

A show cause notice may be issued where a regulator is considering serious action, including suspending or cancelling a service approval. Providers are generally given 30 calendar days to respond in writing, depending on the notice and circumstances

Corrective or remediation action

You may need to demonstrate how the identified issues have been corrected, what contributed to them and what changes have been made to reduce the risk of the same problem recurring.

Child safety and supervision

Child safety should be embedded across recruitment, supervision, policies, staff training and daily practice. From February 2026, strengthened national child safety requirements include mandatory child safety training for relevant early childhood staff and workers.

Providers need to maintain the required staffing arrangements, educator qualifications, ratios and supervision practices. Workforce records should also remain accurate and current as staff join, leave or change roles.

Your Quality Improvement Plan should reflect how the service is performing, where improvements are needed and what the kindergarten is working towards.
Regularly reviewing the QIP and your practices helps make continuous improvement part of everyday operations and keeps the service better prepared for assessment and rating.

Kindergarten assessments and assessment readiness

Kindergarten and preschool services are subject to ongoing regulatory oversight, including inspections, compliance visits and assessment and rating against the National Quality Standard.

In HCPA’s experience across the early learning sector, some services may receive unannounced compliance visits approximately every 6–12 months, while assessment and rating may occur every 2–3 years. The exact frequency is not fixed and will depend on the regulatory authority, the service and its compliance history.

During an assessment, the regulator may review:

  • your Quality Improvement Plan

  • policies and procedures

  • staff and child records

  • management systems

  • compliance history

  • supervision practices

  • planning and educational practices

They may also speak with staff and management and observe how the service operates in practice.

A practical approach is to keep the service assessment-ready throughout the year. This means keeping policies current, maintaining complete records, monitoring qualifications and training, reviewing supervision and child safety practices, and making sure staff understand their responsibilities.

The right response will depend on the notice, but there are four immediate priorities.

Understand the finding and deadline

Review exactly what the regulator has identified, which requirements are involved and when a response or corrective action is due.

Preserve and review the evidence

Bring together the policies, records, staff information, training evidence and operational documents needed to understand what occurred and where the compliance gap sits.

Address immediate risks

Where the issue affects child safety, staffing, supervision or another operational risk, prioritise the practical changes needed to address it.

Build an evidence-based response

Clearly explain what has been reviewed, what action has been taken and what evidence demonstrates the change.

If you believe the rating does not accurately reflect the evidence available at the time, a first tier review may be available. Applications generally need to be made within 14 calendar days of receiving the final report.

If the findings are valid, the priority should be implementing and evidencing the improvements required.

It depends on the type of notice.

For a show cause notice proposing suspension or cancellation of a service approval, the National Law generally provides 30 calendar days for a written response. Other show cause processes can have different timeframes, so always follow the deadline stated in the notice.

A first tier review can be requested through the relevant regulatory authority within 14 calendar days of receiving the final assessment and rating report.

If necessary, a second tier review may subsequently be available through ACECQA.

Yes. Policies should reflect the actual service, its risks, people and operating practices.

Generic documents alone are unlikely to demonstrate that compliance is embedded in the way the kindergarten operates.

Evidence may include policies, records, your Quality Improvement Plan, staffing and qualification information, planning documentation, incident records and examples of how procedures are implemented in practice.

Approved services need to maintain a Quality Improvement Plan that reflects the service’s current practices, strengths and areas for improvement.

The QIP should be treated as an ongoing tool for continuous improvement rather than something prepared only for assessment and rating.

Minor gaps may require corrective action or improvements to your systems.

If your kindergarten has received serious findings, an unsatisfactory assessment outcome, a compliance notice or is facing enforcement action, the priority should shift to understanding the finding and taking the required corrective action.
